GENERAL TERMS AND CONDITIONS OF SALE
I Application
These general terms and conditions of sale (hereinafter: ‘GTCs’) apply to sales transactions concluded by MAISON SAINT CHARLES 310 rue de Vaugirard 75015 Paris with the Customer. They cancel and replace any previous version that may have been posted online and/or accepted by the Customer.
These GTCs apply to all use of the website, in particular to the marketing of all the services offered on the website by MAISON SAINT CHARLES by internet and telephone. It is therefore imperative that the Customer reads the GTCs carefully. It is particularly advised to download and/or print these documents in order to keep a copy on the date of the order, as they may be subject to change. However, it is specified that such modifications will not apply to orders for services made prior to those changes.
The GTCs may be supplemented by specific sales conditions included in the service description, as well as by the sales conditions of the service providers, which can be accessed either on their website or on-site.
II Capacity
The Customer acknowledges having the legal capacity to enter into a contract, meaning they are of legal age and not under guardianship or curatorship. The Customer also declares that they are using the website in accordance with these Terms and Conditions, on their own behalf and on behalf of all beneficiaries of the services ordered by them on the website, for whom they acknowledge being the representative (hereinafter: the ‘Beneficiaries’), and for whom these Terms and Conditions will be enforceable.
The customer is financially responsible for the use of the website made both in their name and on behalf of the beneficiaries, unless they can demonstrate fraudulent use that is not the result of any fault or negligence on their part.
The Customer guarantees the truthfulness and accuracy of the information provided by them, both on their own behalf and on behalf of all beneficiaries using their data on the website. MAISON SAINT CHARLES reserves the right at any time to refuse to enter into a contract with a customer who engages in fraudulent use of the website or violates these Terms and Conditions.
In this regard, we recall the provisions of Article 313-1 of the French Penal Code: ‘Fraud is the act, either by the use of a false name or a false quality, or by the abuse of a true quality, or by the use of fraudulent manoeuvres, to deceive a natural or legal person and thereby induce them, to their detriment or to the detriment of a third party, to hand over funds, valuables, or any goods, to provide a service, or to consent to an act creating an obligation or discharge. Fraud is punishable by five years’ imprisonment and a fine of €375,000′.
III Right of withdrawal
In accordance with the provisions of Article L 121-21-8 of the French Consumer Code, the services offered on the Website by MAISON SAINT CHARLES are not subject to the right of withdrawal provided for in Articles L. 121-21 and following of the French Consumer Code regarding distance selling.
As a result, the services ordered on the Website are exclusively subject to the cancellation and modification conditions set forth in these GTCs, and the Customer cannot invoke the right of withdrawal.
IV Price
Prices are expressed in euros. VAT is included in the proposed rates. Any change in the applicable rate, or any modification or introduction of new legal taxes made by the competent authorities, will be automatically reflected in the prices indicated at the date of the booking.
The rates are per room, based on the number of people specified and the selected period.
The prices indicated only include the services explicitly mentioned in the booking.
Additional services provided by MAISON SAINT CHARLES during the stay, as well as the tourist tax, if applicable, will be added to the price mentioned in the booking. The prices listed on the website are subject to change at any time by MAISON SAINT CHARLES without prior notice or warning. Only the price stated in the booking confirmation by MAISON SAINT CHARLES is binding.
No stay booked prior to the establishment of a potential promotional offer will be eligible for a refund, even partially.
V Online orders
At the time of placing their order, the Customer must necessarily:
fill out the identification form on which they will provide all the requested contact information,
fill out the online order form giving all the references of the chosen products or services,
confirm their order after having checked all the information,
make the payment under the specified conditions and confirm their order and payment in the case of opting for an advance purchase plan, or provide MAISON SAINT CHARLES with their banking details in the case of opting for a flexible plan.
Any booking of more than 5 rooms is subject to special conditions applicable to group bookings (see payment and cancellation conditions VI).

The confirmation of the order implies acceptance of these terms of sale, recognition of having perfect knowledge of them and waiving your own conditions of purchase or other conditions.
All the data provided and the confirmation recorded will be considered as proof of the transaction. The order confirmation acts as a signature and acceptance of the transactions. MAISON SAINT CHARLES sends the customer confirmation of the recorded order via email and/or SMS. The booking is only firm and final upon receipt of the confirmation sent to the customer by MAISON SAINT CHARLES. The rates, terms and conditions of a booking are intended for the sale of hotel rooms in accordance with their primary purpose (accommodation). MAISON SAINT CHARLES reserves the right to modify the rates, terms and conditions, or to cancel the booking altogether, if the rooms are used for purposes other than accommodation, such as photo shoots, film shoots, showrooms, or interviews.
VI Online payment terms
Depending on the type of booking made, the price is payable in full at the time of placing the order (advance purchase plan) or during the Customer’s stay at MAISON SAINT CHARLES (flexible plan). In all cases, and to guarantee the booking, the Customer is required to provide their credit card number, with transmission occurring through a secure method. In the event of payment at the time of placing the order, the credit card information provided by the Customer through a secure system to MAISON SAINT CHARLES allows the latter to charge the card for the total amount of the stay, always in a secure manner. The Customer’s bank account is debited on the day of the order, and the invoice is provided by MAISON SAINT CHARLES to the Customer on the day of their departure from the establishment. Please note that the credit card used for the booking must be presented upon arrival by the cardholder. Otherwise, a new credit card will be requested for payment on arrival. In the case of a third party covering the stay, the MAISON SAINT CHARLES will require documentation to ensure the security of the transaction. Please also note that the MAISON SAINT CHARLES reserves the right to carry out a pre-authorisation on your credit card at any time before your arrival.
- Payment terms for groups
- At the time of booking : 50% of the total amount of the booking
- D-30 : 40% of the total amount of the booking
- D-15 : 10% of the total amount of the booking
VII Changing and/or cancelling a booking
Cancellations and/or modifications of bookings may be allowed depending on the pricing plan chosen by the Customer.
In the case of opting for a flexible plan, any request for modification and/or cancellation of a booking must be made 48 hours prior to the start of the stay.
During special events, this deadline is extended to 72 hours.
In the case of choosing an advance purchase plan, no modifications or cancellations will be accepted, and the total amount for the stay will remain with MAISON SAINT CHARLES, with no entitlement to any refund for the Customer.
In the event of the customer’s no-show at MAISON SAINT CHARLES and in the absence of cancellation:
The total amount of the booking will be retained by MAISON SAINT CHARLES in the case of an ‘Advance Purchase’ booking;
The first night’s charge will be applied by MAISON SAINT CHARLES in the case of a ‘Flexible Plan’ booking. Furthermore, for a stay of at least 2 nights, in the event of the customer’s no-show on the first day of the stay, MAISON SAINT CHARLES is not obliged to hold the room for the remaining duration of the stay.
VIII Group cancellation policy
Total cancellation
- More than 45 days before the group’s arrival: no cancellation fee
- From less than 45 days to 30 days before the group’s arrival: 50% of the total amount
- Less than 30 days before the group’s arrival: 100% of the total amount
Partial cancellation
- More than 45 days from the date of arrival: No cancellation fee
- From less than 45 days to 15 days before the group’s arrival: 10% of the rooms may be cancelled without charge; beyond that, the room will be billed at 90% of the duration of the stay.
- Less than 45 days before the group’s arrival: any cancelled room will be charged at 100%
IX Relocation
In the event that Maison Saint-Charles is unavailable or in cases of force majeure, it reserves the right to accommodate the Customer fully or partially in a hotel of equivalent or higher category, offering similar services. The transfer will then be at the expense of MAISON SAINT CHARLES, which will not be liable for any additional compensation.
X Force majeure
Force majeure means any event external to the parties of an unpredictable and insurmountable nature that prevents either the customer or MAISON SAINT CHARLES from insuring all or part of the obligations provided for in the contract. This applies especially in cases of strikes, insurrections, riots or prohibitions imposed by governmental or public authorities. It is expressly agreed that, for the parties, force majeure suspends the execution of their reciprocal obligations and that each party shall bear the burden of the resulting costs. Customers will be solely responsible for any additional costs incurred to continue their journey due to the occurrence of a force majeure event.
XI Complaints
Any complaint must be sent to the following address: MAISON SAINT CHARLES, 310 rue de Vaugirard, 75015 Paris, France, within 15 days following the departure from the stay in question. No complaint will be considered after this delay.
XII Data Protection and Privacy
Pursuant to law 78-17, known as the Database and Privacy law, customers are informed that their booking is subject to the processing of personal data. Customers have a right to access and rectify the data entered, which can be exercised at the registered office: MAISON SAINT CHARLES 310 rue de Vaugirard 75015 Paris – France. It is specified that this data is not communicated to third parties. The Company offers Wi-Fi internet access. The Customer agrees that the IT resources provided to them will not be used in any way for the reproduction, representation, distribution or public communication of works or objects protected by copyright or neighbouring rights, such as texts, photographs, audiovisual works, software and video games, without the authorisation of the rights holders specified in Books I and II of the Intellectual Property Code when such authorisation is required.MAISON SAINT CHARLES is equipped with a video surveillance system in the common areas of the building.
XIII Responsibilities
MAISON SAINT CHARLES declines all responsibility in the event of theft, loss or damage to the belongings of customers during their stay. The Customer shall be held responsible for any damage, degradation, or acts of vandalism that may occur due to the occupation of the premises and/or as a result of the participants and/or staff under their supervision, affecting both movable and immovable property, whether owned by MAISON SAINT CHARLES or not. As a result, MAISON SAINT CHARLES reserves the right to ask the Customer to leave the establishment without any compensation or refund for the current stay, and to reimburse the damages caused by these acts. MAISON SAINT CHARLES is only obligated to provide reasonable efforts in the online sales process. Their liability does not extend to damages resulting from the use of the internet such as data loss, intrusion, viruses, breaks in service, or other unintended problems.
XIV Applicable Law
These General Terms and Conditions of Sale are governed by French law. This shall apply to both substantive and formal rules. Disputes will fall under the exclusive jurisdiction of the French courts.
